Complaint Procedures

Title IX is a federal law that prohibits discrimination on the basis of sex in educational programs and activities. Title IX required TTUSD to take immediate and appropriate action to investigate when it knows or reasonably should know of possible Title IX violations.

Students have the following rights based on this federal law

• You have the right to fair and equitable treatment and you shall not be discriminated against based on your sex.
• You have the right to be provided with an equitable opportunity to participate in all academic extracurricular activities, including athletics.
• You have the right to inquire of the athletic director of your school as to the athletic opportunities offered by the school.
• You have the right to apply for athletic scholarships.
• You have the right to receive equitable treatment and benefits in the provision of all of the following:
  • Equipment and supplies.
  • Scheduling of games and practices.
  • Transportation and daily allowances.
  • Access to tutoring.
  • Coaching.
  • Locker rooms.
  • Practice and competitive facilities.
  • Medical and training facilities and services.
  • Publicity.
• You have the right to have access to a gender equity coordinator to answer questions regarding gender equity laws.
• You have the right to contact the State Department of Education and the California Interscholastic Federation to access information on gender equity laws.
• You have the right to file a confidential discrimination complaint with the United States Office of Civil Rights or the State Department of Education if you believe you have been discriminated against or if you believe you have received unequal treatment on the basis of your sex.
• You have the right to pursue civil remedies if you have been discriminated against.
• You have the right to be protected against retaliation if you file a discrimination complaint.

Filing a Title IX Complaint

• Report the Incident
  • Report the incident to any school staff member or directly to the TTUSD Student Title IX Coordinator. 
• File a Written Complaint
  • File a complaint using the Uniform Complaint Form which is in alignment with Board Policy 1312.3.
  • A TTUSD administrative staff member or our Student Title IX Coordinator can assist in this process if needed.
• Time Limits
  • It is best to file your complaint as soon as possible after the incident.
  • Complaints must be filed within six months from the date when the alleged unlawful discrimination occurred, or from the date the complainant first obtained knowledge of the alleged discrimination, harassment, intimidation, or bullying based on sex.
  • In some cases, the time for filing may be extended up to 90 days by the Superintendent or the Superintendent’s designee, for good cause, upon written request by the complainant setting forth the reasons for the request for an extension of time to file a written complaint.  
• Investigation
  • Once a complaint is filed, the compliance officer, or designee, will begin an investigation within 10 business days. 
  • The complainant, or complainant's representative, will have an opportunity to present evidence, or information leading to evidence, to support the allegations. 
• Decision & Appeal
  • The school district will issue a written decision within 60 days of receiving the written complaint.
  • If unsatisfied with the decision, the complainant may file an appeal in writing to the California Department of Education within 15 calendar days of receiving TTUSD's decision. 
• External Complaint Option
  • Complainants may also bypass filing with TTUSD to file directly with the U.S. Department of Education within 180 days of the alleged discrimination.

The Uniform Complaint Procedures (UCP), as outlined in Board Policy 1312.3 apply to complaints alleging a violation of applicable state and federal laws and regulations governing educational programs.

The UCP shall be used to investigate and resolve the following allegations

• Complaints concerning district employees
• Complaints concerning instructional materials
• Complaints regarding teacher vacancy or misassignment
• Complaints regarding the condition of school facilities

As a community, we need to work together to keep our schools safe. If anyone - a student, parent, staff person or member of the community - sees something they perceive to be unsafe or something that doesn't seem right, it is critical that they take action and report the situation or incident immediately.
